Three Departments Jointly Issue "Action Plan for Agricultural Brand Protection Campaign (2026–2027)"

Three departments crack down on agricultural brand infringement, targeting counterfeit names, fake products, and malicious trademark squatting.

To fully implement the decisions and deployments of the CPC Central Committee and the State Council, strengthen agricultural brand protection, crack down on infringement and illegal activities, create a fair and orderly market environment, boost consumer confidence, and safeguard farmers' interests, the Ministry of Agriculture and Rural Affairs, the State Administration for Market Regulation, and the National Intellectual Property Administration jointly issued the "Implementation Plan for the Special Action on Agricultural Brand Protection (2026–2027)."This special campaign includes four key tasks:

FirstStrengthen enforcement of quality and safety supervision for primary agricultural products.Advance brand licensing management and establish a traceability system covering production, processing, and sales. Prioritize full-chain traceability for branded agricultural products to ensure origins are verifiable, destinations are trackable, and responsibilities are enforceable.

Investigate and penalize violations of collective mark and certification mark usage management rules in accordance with the law.

ThirdCrack down on unfair competition.Crack down on unfair competition practices such as "free-riding" and "brand-jacking." Prioritize investigations into unauthorized use of well-known regional public brands and geographical indication brands, including confusion caused by similar names, packaging, or trade dress. Also target false or misleading commercial promotions regarding product performance, functionality, quality, sales records, user reviews, or past awards, as well as acts that damage competitors through commercial disparagement.

FourthlyStrengthen administrative protection of intellectual property rights in the agricultural sector.Support agricultural brand entities in securing comprehensive intellectual property protection through trademarks, patents, geographical indications, and new plant varieties.Standardize trademark registration management to prevent and stop malicious squatting.
